Mistrial in Wichita

John Kerns got a mistrial in State v. Penn, a Sedgwick County rape/agg sodomy prosecution due to the prosecutor's failure to turn over Brady material. I haven't practiced in Wichita since 1994, but it's interesting to hear that the same prosecutor is up to the same tactics. Thanks to Jeff Wicks for the tip.
